Oregon Legislature passed the Building Performance Standard (BPS) in 2023, requiring many buildings to measure and reduce their energy use. As of August 5, 2025, building owners must begin tracking energy consumption and reporting performance data to meet state requirements.

Our Oregon BEPS team – Luke Jarmer, Kelly Lamb, Casey McDonald, and Kathleen Smith – is ready to guide you through the process.


Which Buildings are Affected?

The BPS divides buildings into two tiers:

    • Tier 1 buildings* – Hotels, motels, and non-residential buildings ≥ 35,000 sq. ft.
    • Tier 2 buildings – Hospitals, schools, and multifamily residential buildings ≥ 35,000 sq. ft.; plus hotels, motels, and non-residential buildings 20,000–35,000 sq. ft.

All affected buildings must benchmark their energy performance by reporting Energy Use Intensity (EUI)—energy use per square foot—against targets set by the state based on ASHRAE standards.

* Tier 1 buildings also require an energy audit by a Certified Energy Manager (CEM) and a formal Energy Management Plan (EMP).


Important Dates

Compliance deadlines start July 1, 2028 for the largest buildings, with all affected properties required to comply by July 1, 2030. Early action can lead to lower operating costs and smoother compliance. Buildings that miss deadlines face financial penalties.

The state is also developing an incentive program to help with compliance—contact us for updates as details are released.
